The Distinguishing Hallmarks Of A Competent Personal Injury Attorney

Interviewer: What other factors would you say differentiate you from other personal injury attorneys?

Guy DiMartino: I've handled a number of cases on both sides of the coin. I've represented insurance companies and their drivers and I now represent injured folks. Additionally, being a chiropractor gives me an advantage because I have a strong background in how the body works, how it is injured, and how it heals. So, what makes me different in this respect is a lot of times, I do not have to spend a ton of money on expert witnesses because I understand the concepts surrounding the client's injury, so I don't have to have a doctor educate me where I'm paying them $1,000 to bring me up to speed on the medical issues in a case, which gets translated back to the client. If I have to spend $5,000 to prep with an expert witness, eventually the client is going to have to pay that expense.

The Qualities To Look For When Retaining A Personal Injury Attorney For An Auto-Accident Claim

Interviewer: If God forbid you're injured in an auto accident and you're seeking an attorney; What would you look for to actually know the person you're taking to is the right one versus other folks?

Guy DiMartino: I would want an attorney to give me information, me as somebody who's injured, I would want to know about the process, I would want information, and I would want an attorney that would be able to lead me through the process and give me the straight narrow regarding the claim. I wouldn't want a lawyer that's going to say, “Oh, your case is worth million dollars”, and then, two years down the road say, “Oh, the insurance company is offering you $5,000”. So, if you have a lawyer that's going to tell you, “Hey, I'm going to guarantee that you're going to get so and so”, I would do either two things. Ask them to put that guarantee in writing, or turn and walk away. Finally, these cases are partnership, it's a partnership between the lawyer and the client. The client is invested in the lawyer believing that the lawyer is going to do the right thing by them, however, the lawyer is also invested in the client believing that the client is going to do the right thing. When I decide to accept the case, I am giving the client my time, my energy and my money because I'm the one who's putting the money out to fund this case. And so, it's a partnership.

Hiring A Lawyer is Similar to Creating a Partnership, The Client and the Attorney Need to be on the Same Page

With it being a partnership, you need to hire a lawyer that you like, you need to hire a lawyer that you can get along with and you need to hire a lawyer that communicates the same way that you communicate. If you're somebody who wants to come in and see a lawyer once a week in the office, you have to make sure that that's something that resonates with your lawyer. If you're somebody who just wants an email or a text regarding your case once a month, and your lawyer doesn't text or email, then that's probably not the lawyer for you because that's the lawyer that might want you to come in and meet with him or her once a month. You know, there are a lot of great lawyers out there, so you'll have to find the right one for you that works with your personality.
