Michigan City Indiana Lawyer |Speed Related To Boating Accidents

Posted by Guy DiMartino | Oct 31, 2014 | 0 Comments

Michigan City, Indiana boating accident lawyer discusses a recent newspaper article reporting a boat accident.

The June 8th edition of the Post-Tribune reported that two men were injured in a boating accident near Burns Harbor, Indiana.

The newspaper reported that the accident occurred around 3:45 a.m. and the boat had been speeding before it hit a break wall in the Port. One passenger was airlifted to Christ Hospital in Oak Lawn, Illinois.  In boating accidents people are severely injured.  I have dealt with situations where people have been chopped up by the prop, run over by the boat, or injured when the boat crashes into a stationary object like this case.

Speed is a major cause of boating accidents in Indiana causing injury to recreational boaters.

The common theme in many boat accident cases is the driver's negligence.  The boat is either traveling too fast, the driver is not paying attention, or people are horsing around. Boats are fun but they are also dangerous and should be respected because boating accidents can cause  severe injuries or death.

Most boating accident cases are covered under Maritime – Admiralty law, which has its own set of rules and procedures. If somebody is injured in an Indiana boating accident and wants to seek compensation for their medical bills and injuries the following questions have to be answered:

  • Was the owner of the boat on the boat at the time of the accident?
  • Is there any insurance coverage available?
  • Does the owner or driver of the boat have a boating (marine) policy, homeowners policy or personal liability umbrella policy?
  • Is there a chance the owner of the boat will be able to limit the amount of money available to the injured person to the value of the boat?

If you or a family member should ever need a lawyer for a Michigan City boating accident case, make sure the attorney has an understanding of Admiralty law.  If you have any questions about a boating accident case, you can give us a call at (219) 874-4878or fill out the internet consultation form on the right.
