Dog Bite While Working

Q. I am a letter carrier and I was attacked by a dog while delivering mail. I've been told that there is a one free bite rule for dog bite cases is that true?

A. This answer requires a little explanation. You are right, under the common law there is what people call a “one free bite” rule and that is directed to a dog's alleged dangerous propensity.

The standard is different for you because you are a letter carrier. The one free bite rule doesn't apply to postal carriers and other public servants who are bitten or attacked while on someone else's property doing their job.

In order to proceed with your claim, you don't have to show that dog has previously attacked someone else or otherwise exhibited bad behavior in the past.
